The success of any government procurement depends, in no small part, on the type of contract, e.g., whether it’s fixed-price or cost reimbursement. Therefore, selecting the right type of contract at the outset is critical for both the government and the contractor. For the contractor, it directly impacts profit and loss. The contract type determines the allocation of cost and performance risk; the degree of management and oversight that will be needed; the payment mechanism that will be used; and specifies incentives that can balance risks, motivate the contractor to perform and control costs, and be financially rewarding to the contractor.

Fred Geldon, Adjunct Professor, George Mason University
Prior to his retirement in January 2009, Fred Geldon was an attorney at Electronic Data Systems for 21 years, where he served as counsel and as Director of the Contracts and Legal Division and was responsible for handling or supervising all contract and legal matters involving EDS’ federal government customers. Prior to his EDS tenure, Mr. Geldon was a partner at two law firms and Assistant Director of the Torts Branch of the Department of Justice. Mr. Geldon is currently an Adjunct Professor of Computer Science at George Mason University and regularly lectures on government contracts subjects for Public Contracting Institute and other organizations.
